Release Acceptance

In consideration for free product to be delivered to me upon execution of this Release and other valuable consideration, the receipt and sufficiency of which is hereby acknowledged by the individual or entity listed above, collectively and/or individually, and on behalf of any and all related companies, divisions, agents, employees, successors, and heirs (collectively and individually “Releasor”) hereby release and forever discharge and hold harmless Z Tags North America, L.P. and its related companies, divisions, agents, employees, successors, and heirs (collectively and individually “Z Tags”) from and against any injuries, harm, damages, costs, expenses, losses, liabilities, lawsuits, actions, claims, and/or demands whatsoever, whether KNOWN AND/OR UNKNOWN, FORESEEN AND/OR UNFORESEEN, of any kind whatsoever, involving Releasor or any animals or other property owned by Releasor or any client(s) of Releasor, arising out the receipt or use of the free product. Z Tags shall have the absolute right and all permission necessary to copyright, publish, and/or reprint the testimonial(s) of Releasor as shown on Exhibit A attached hereto, edited as deemed desirable by Z Tags in its sole discretion (including, but not limited to, stories concerning the animals which refer to Releasor or which use Releasor’s picture, portrait or likeness or comments to Z Tags employees or reports of field study results) written or otherwise, concerning the free product or any animals of Releasor or any clients of Releasor. Releasor understands that any such testimonial shall be the property of Z Tags and may be used, or caused to be used, in Z Tags sole discretion, for any and all exhibitions, public displays, publications, commercial art, advertising, trade, and any other lawful purpose whatsoever, without any limitation or reservations, and without any compensation to Releasor other than the free product provided by Z Tags. Z Tags shall have the absolute right and all permission to publish and/or reprint via any medium, the image(s) and/or logo(s) of Releasor as shown on Exhibit A attached hereto. Z Tags shall ensure that trademark credits as requested by Releasor are included in any Z Tags publication/printing of said image(s) and/or logo(s), which image(s) and/or logo(s) shall be and remain the property of Releasor. Releasor hereby waives any right that Releasor may have to inspect and/or approve the finished product or advertising copy that may be used in connection with Releasor’s testimonial(s), image(s) and/or logo(s) or the use to which such may be applied. Releasor further releases, discharges, and agrees to hold harmless Z Tags and its related companies, divisions, agents, employees, successors, and heirs from and against any injuries, harm, damages, costs, expenses, losses, liabilities, lawsuits, actions, claims, and/or demands of any kind whatsoever arising out of any lawful use of such testimonial(s), image(s) and/or logo(s).
